it is if it's listed as an auction from the start. but for a listing "buy it now" with best offer, then once the offer is accepted by the seller, both are bound to complete the transaction.

Sierra says they support Gobi API, and I saw some reference somewhere about Gobi4000 (i.e. when you configure a new Lenovo with Gobi4000, you have to choose the operator (Verizon, ATT, etc). Gobi2000 was indeed universal (US, EU, 2G, 3G), not sure about 3000 or 4000 for that matter. I hope too gobi5...
